NLRB Further Delays the Effective Date of New Employee Rights Posting to April 30, 2012

The National Labor Relations Board (NLRB) has issued a press release further postponing the implementation of its new employee rights posting requirement from January 31, 2012 to April 30, 2012.  The NLRB explained that the posting requirement is being further postponed at the request of the federal court that is hearing a legal challenge to this requirement.  The deadline for posting was originally November 14, 2011, but the NLRB previously extended this deadline to January 31, 2012, "to allow for enhanced education and outreach to employers."

As discussed in our September 22, 2011 E-Update, the posting requirement stems from a recent NLRB final rule that requires all employers that fall under the NLRB's jurisdiction (which includes most private employers) to post a notice informing employees of their rights under the National Labor Relations Act, including, among other things, the right to form, join or assist a union and bargain collectively.  The notice can be downloaded here.
